1. About these terms
These terms apply when you buy a service from askprodesign through askprodesign.com or by agreement with us. By placing an order, you accept them. If you are a consumer, nothing in these terms limits your statutory rights.
2. Our services
We sell the packages described on our service pages and on /pricing/: Custom Website Design, E-commerce Websites, Landing Pages, Website Redesign, Website Audit and UX Review, and Care Plans. Each package has a stated scope, page or product limit, price and turnaround. Anything outside the stated scope is quoted separately and agreed before work begins.
3. Orders and contract
Your order is an offer to buy. A contract is formed when we confirm it by email. We may decline an order, for example if we cannot meet the stated turnaround, and we will refund anything you have paid.
4. Prices and payment
Prices are in euro and include VAT where it applies. We do not charge hidden fees. Unless the order says otherwise:
- Projects (Website Design, E-commerce, Landing Pages, Redesign): 50% when you order and the balance at launch.
- Website Audits: 100% when you order.
- Care Plans: the first month when you order, then monthly in advance.
Our checkout currently runs in test mode. While it does, no real payment is taken, and orders placed are test orders. We will tell you before live payments begin.
5. Timelines
The turnaround stated for each package starts when we have received the deposit and the brief. Timelines depend on your timely feedback and content. If you are late, the launch date moves by the same amount. If we are late for reasons within our control, we will tell you promptly and agree a new date.
6. What we need from you
You agree to give us accurate information, content you have the right to use, and feedback within a reasonable time. You are responsible for the legality of your content and for having the right to use any text, images or logos you give us.
7. Changes and revisions
Each project package includes two rounds of changes in the review phase unless the package states otherwise. Further changes, and changes outside the agreed scope, are quoted at a fixed price before we do them.
8. Ownership and intellectual property
- Domains and accounts (hosting, analytics and similar) are registered in your name or transferred to you at launch.
- On receipt of full payment, ownership of the design, code and content we created for you passes to you. Until then, we license them to you for the project.
- Your content, logo and brand stay yours.
- Third-party software and fonts (for example open-source libraries) remain under their own licences, which we will list in the handover.
- We may describe the project in our portfolio unless you ask us not to. We will not show your confidential information.
9. Hosting and third parties
Hosting, domains, payment providers and similar services are supplied by third parties under their own terms, and are normally paid directly by you. We are not responsible for failures of third-party services.
10. Care Plans
A Care Plan covers the services in its description. Edit hours do not roll over. You may cancel at any time by emailing us; cancellation takes effect at the end of the month you have paid for. Cancelling does not affect ownership.
11. Website Audits
A Website Audit is an opinion based on our review at a point in time. We do not promise improvements in ranking, traffic or sales.
12. Performance and accessibility
We build to a target of Lighthouse 90+ on mobile and WCAG AA. These are build targets for the delivered pages, checked before launch. Results depend on your content, hosting and later changes, and are not a guarantee of how your site will perform in the future.
13. Cancellation and refunds
These are set out in our Refunds and Cancellations policy, which forms part of these terms.
14. Liability
We will carry out the services with reasonable care and skill. We are not liable for losses we could not reasonably have foreseen, or for indirect losses such as lost profit, lost data or lost business opportunity. Our total liability for any order is limited to the amount you paid us for that order. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law, including your rights under the Consumer Rights Act 2022 where you are a consumer.
15. Confidentiality and data
We keep your non-public business information confidential. We handle personal data as described in our Privacy Policy.
16. Ending a contract
Either of us may end a contract if the other materially breaches it and does not fix the breach within 14 days of written notice. Sums due for work done up to that point remain payable.
17. Changes to these terms
We may update these terms. The version in force when you order applies to that order.
18. Governing law
These terms are governed by the laws of Ireland. The courts of Ireland have jurisdiction, without affecting any right a consumer has to bring proceedings in their country of residence.
